For many who are currently renting and may be tempted to now buy a home due to the historically low interest rates as well as the decline in home prices, one concern that may affect their decision is the fact that their current lease may not expire for another 6 months to 1 year, sometimes even longer. While the landlord may seek to enforce the lease against you for the remainder of the lease term, the landlord has the legal obligation to try to rent the apartment n a good faith manner. The sooner the landlord is notified that you plan on leaving before the lease term expires, the better. This way, he can make arrangements to find another tenant and not pursue legal action against you for breaking the lease. Be careful however to not give notice until you are sure that your financing of the home has been approved. Also, it is a good idea to have your attorney confirm that there are no title issues that will delay or possibly prevent the closing from occurring.
